1. Acceptance of Terms

By accessing or using Bloom ("the Service"), including the mobile application and website, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Bloom is a plant identification and care application that uses artificial intelligence to help users identify plants, receive personalized care recommendations, diagnose plant problems, and manage their plant collections.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 13 years old to create an account.

4. Subscriptions and Payments

Bloom offers both free and premium subscription plans. Premium subscriptions are processed through RevenueCat and the respective app stores (Apple App Store and Google Play Store).

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription through your app store account settings.
  • Refunds are handled according to the policies of the respective app store.
  • Prices may change with reasonable notice. Existing subscribers will be notified before any price increase takes effect.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Upload malicious content, viruses, or harmful code.
  • Scrape, crawl, or use automated tools to extract data from the Service without permission.
  • Impersonate another person or misrepresent your affiliation.
  • Interfere with or disrupt the Service or its infrastructure.

6. User Content

You retain ownership of the photos and content you upload to Bloom. By uploading content, you grant us a limited license to process, store, and display it as necessary to provide the Service (e.g., plant identification and care recommendations).

You are responsible for ensuring you have the right to upload any content you submit.

7. AI-Generated Content Disclaimer

Bloom uses artificial intelligence to provide plant identifications and care recommendations. While we strive for accuracy:

  • AI-generated results are provided for informational purposes only and may contain errors.
  • Do not rely solely on Bloom for identifying potentially toxic or dangerous plants.
  • Always consult a qualified professional for critical plant-related decisions, especially regarding plant toxicity to humans or pets.

8. Intellectual Property

The Service, including its design, code, logos, and content (excluding user-uploaded content), is the property of Bloom and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind.
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
  • We are not responsible for any harm resulting from reliance on plant identifications or care recommendations provided by the Service.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms of Use. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these Terms of Use from time to time. Material changes will be communicated through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of Brazil.
